PartyLite Text Messaging Terms & Conditions
Your use of the PartyLite Gifts, Inc. ("PartyLite") text message service ("the Service") is governed by the terms and conditions set forth herein.  Use of the Service constitutes your acceptance of these terms, which take effect when you sign up for the Service.  If you do not agree to these terms, please do not sign up for the Service.  You must be 18 or over to use this Service.

PartyLite will provide text message announcements related to sales, online and offline promotions and other exciting business developments (which may include the latest updates on products, contests, special offers, polls and trivia) to users who have agreed to receive such communications from the web or from our keyword opt-in.

Users who opt in to the Service may receive up to eight (8) messages from PartyLite per month.  There is no additional charge from PartyLite related to this service – however, message and data rates may apply and you are responsible for those charges.  Please consult your service agreement with your wireless carrier to determine your phone’s pricing plan.  Participating wireless carriers include but are not limited to AT&T, Verizon Wireless, Sprint, T-Mobile, Nextel, Virgin Mobile, Boost, CellularOne, US Cellular, and Alltel.  PartyLite may add or remove any wireless carrier from this program without notice.  If your mobile operator is not participating, you will not receive a reply to your messages.  Pre-paid users may not be able to participate.

To stop the Service at any time, text STOP to 303-64.  You agree to receive a confirmation opt-out text if you text STOP to 303-64.  Text HELP to 303-64 to receive help information, or just reply HELP to any message.

Before changing your mobile phone number, you agree that you will opt out of the Service.  To opt back in with your new mobile number text the keyword to 303-64.

Any text messages you send to PartyLite become our property.  No remuneration is implied or offered.  News and data delivered are believed to be accurate at the time of delivery.

PartyLite reserves the right to change these terms and conditions or cancel the Service at any time.  Please check these terms on a regular basis for changes. Your continued use of the Service after changes are posted will mean that you accept the terms as modified by the posted changes.

PartyLite makes no representations or warranties whatsoever regarding the Service.  PartyLite hereby disclaims all warranties, including any implied representations or warranties of merchantability or fitness for a particular purpose.

You expressly agree to indemnify, defend, and hold harmless PartyLite, its directors, officers, employees, Consultants, Leaders, and affiliates from and against any and all claims, damages, liabilities, actions, causes of action, costs, expenses (including reasonable attorneys' fees), judgments, or penalties of any kind or nature whatsoever arising from your use of the Service.

These terms shall be construed in accordance with the laws of the Commonwealth of Massachusetts, and any arbitration or judicial proceedings to enforce or interpret the terms hereof may be brought only in Plymouth, Massachusetts.
